One of two suspected armed robbers is now facing murder charges after his partner in crime was killed by their would be victim in Albuquerque, New Mexico.

According to KRQE,

According to the criminal complaint, Ruben Lucero and Christopher Garza entered the store just before 7 p.m. Monday night with a pistol and an AR-15 assault rifle.

Deputies say one of them threatened the clerk, who is the owner’s son. He handed over $100 and his watch, while the other robber forced three of the clerk’s family members to the ground, including a young girl.

The clerk told deputies that after the robbers left, he went to lock the door and saw one of the robbers point a gun at him from their Mercedes. That’s when he says he opened fire.

“My aunt definitely saw two guys run out,” Josh Dunlap said. “The owner took about three to four shots. When they got in the car, he took about two to three more as they sped down the road,” Dunlap said.

The car then crashed nearby. One of the suspects died due to fatal gunshot wounds and the other suspect was apprehended by police.

The surviving suspect is being charged with murder for the death of the first suspect.

This is the 13th defensive gun use we’ve documented in the state of New Mexico and the 1,325th defensive gun use we’ve documented overall.
