    Almost identical situation to the OK pharmacist who shot and killed an unconscious robber. He was convicted.

    Yeah sucks to be that guy... Although it sounds like the initial shoot was fine, shooting and killing an already disabled suspect would be murder, legally speaking. Although one may be justified in using deadly force, one may not shoot to kill. Shoot to stop the threat - once the badguy is no longer able to pose such a threat all force must cease. Now, if on his return to the store badguy #1 was conscious and perhaps tried to shoot the clerk despite his injuries, he would be ok... But that doesn't sound like the case here.
