Mother of Armed Robber Killed by Armed Kroger Employee Suing Kroger for $75k

The mother of Jeremy Atkinson, who attempted to rob a Kroger in Indianapolis 6 months ago and was shot by an armed store employee during that robbery, is suing Kroger. She says Kroger is liable for her son’s death because Kroger failed to properly enforce its policy that forbids employees from carrying guns while working.

Atkinson has a prior criminal history and did prison time for a previous armed robbery. The Kroger employee who stopped the robbery was generally heralded as a hero by the general public and co-workers.

    Seriously? Dude, you tried to hold up a store, and got shot yourself. Then Mom goes crazy over that crap? I’m sorry ma’am, your son attempted something dangerous and was hurt doing so. The 2nd amendment is put in place so we can defend ourselves against people like this man. If more people armed themselves and obeyed the law, we wouldn’t have as much armed robbery.

    This has to be one of the dumbest thing i have heard in a long time . Look woman your son was a criminal , You want to blame some one for his death you need to blame your self . You obviously did not raise him right and teach him right from wrong that is a big part of why he is a criminal .

    If you don’t want to be shot or killed then don’t threaten peoples lives don’t try robbing people and carrying on with criminal activity’s and you won’t be in danger of being killed by armed law abiding citizens .

    You know this woman was a piss poor mom just by the way she is reacting , What law abiding citizens with common sense would even think about suing some one who protected his life and other peoples lifes from a criminal . I think people like this woman should be fined out the ass for even trying to bring this law suet into court , any judge that takes this in his court should toss it out and then order the woman to pay $5,000 in fines for wasting the courts time .

    A criminal tries to commit a crime and loses his life in the process.
    Looks like suicide to me.
    I don’t think Mama is going to make much money off of Li’l Jeremy’s self-destructive act.

    I believe that Kroger should go after the guy’s mother for payment of all the clean up cost, sending other employees to the dr. and any other money they are out because of that dirt bag!!!!!!

    If this even GOES to court, then actions officially have no consequences.
    We’ll be able to do anything we want, then blame our victims.

    I am a 2nd ammendment activist. I also belive in responsible gun ownership and following laws and policies that apply to conceal carry. The store clerk very may have saved lives that day… But, he did break company policy which like many jobs forbids it’s employess to have weapons on them while working. This is one of those catch 22 situations. The mother will probably win the lawsuit and the clerk will more then likely if he hasn’t already, lose his job. Sad but true. That’s why I was glad when the law that allowed companies to inforce no guns even on company property, use to not even be allowed to have your weapon in your vechicle. Gun laws need to made and adjusted that is in favor of responsible owners and have greater punishments for the bad guys. Remember just because you have a ccw, doesn’t mean you are allowed to carry it anywhere you want to, unfortunately.

      I carry everyplace. If something happens and you need to use your gun you think policy will mean anything ? Concealed is Concealed along with that keep big mouth shut then you will be good to go

    Tough cookies. Maybe if she had raised him to be something besides a thug, he’d still be alive. This should never make it to court.

    All of the Kroger employees, individually, should COUNTER-SUE THE MOTHER of this thug citing parental negligence for raising such a stain upon this planet.

    Surprise, surprise, another money grubbing , do-nothing looking to make a quick buck by whatever means presents itself. This kind of behavior makes me sick. Too bad so many people these days see something like this as an opportunity to cash in. Don’t want dead kids? Teach them to be useful, responsible, law-abiding members of society.

    Personally I feel if innocent people are put into a situation like being robbed they have every right to protect themselves. And yes the store employees, and the clerk who was being robbed should counter sue for mental anguish, psychological damage, and suffrage. See how she likes those apples, and all these things I mentioned above are legitimate reason for lawsuit.

    The end does justify the means in this instance, the Kroger employee saved lives. If the employee with the gun had a carry permit then he did not break any laws. Breaking company policy gives Kroger the right to terminate him and they should. Then hire him back the next day. The world is a better place with Jeremy gone. Many of these posts are correct, if Kroger is responsible for Jeremy’s death then his mother is responsible for the pain and anguish that her son has caused during the commission of the crime and should be held civilly libel. Her son was illegally in possession of a firearm and she failed to enforce that law and her son used that weapon to commit a crime. She is just as libel for not enforcing that policy as Kroger was for not enforcing theirs and she should be counter sued.

    I agree with the above comments, was Kroger suppose to put up a sign that says no robbery on site; or a sign for no taking hostages? Kroger and her son are both suppose to follow the law. Kroger has no moral obligation to anything contrary to state law.

    Interesting…let’s say she is successful in her pursuit of Kroger and wins the lawsuit. Would that precedent by the courts cause companies to change their “no gun allowed” policy to avoid potentially also being sued in the event of an employee DGU at their facility?

    I hope the judge dismisses the plaintiff’s case with prejudice and awards costs and fees to the defendant. Kroger should sue for defamation, malicious prosecution and harassment asking $1 million in damages – and win – and then have every piece of property seized from this whacked-out bitch.

    When you attempt to rob a store, you assume the risk of being killed. It’s not an invitation for mama to get rich from her son’s crime.

    And if Obama had a son, he would look like Jeremy Atkinson.

    Well folks .the sad part is she will win ! Not in a court of law .Kroger will settle this out court to avoid anymore cost and negitive media coverage. That s just the way it works ,and her lawyer knows this that’s why the amount is only $75k there just working the system .. $75k is a drop in the bucket and worth it to make it go away .and of course the employee will loose his Job.

    So what this woman is saying, is that its ok for her son to bring a gun into a store to rob it, but not for the employee to bring one into the store to defend himself? Sounds to me like someone did the world a favor by cleaning up the gene pool

    Wow – it’s amazing how people don’t look at the root cause of what started all of this. I think the mother forgot that there’s a law about people who has intentions of carrying a weapon causing bodily harm to others. Is she on crack? I am for the employee for quick thinking and protecting their lives.
