[Video] NY District Attorney Will NOT Prosecute Man Arrested Under NY SAFE Act For 2 Extra Bullets

The Columbia County District Attorney Paul Czajka has announced he will not prosecute the first person arrested for violating NY’s new SAFE Act requirement that limits magazine capacity to 7 rounds.

Under the new law residents may posses magazines that can contain 10 rounds of ammunition, but may only store up to 7 rounds in the magazine.

Screen Shot 2013-05-23 at 6.50.23 PMWe reported on the man who was arrested a couple of weeks ago. He was pulled over for improper illumination of his license plate. During the traffic stop police found a legal handgun in the car, but also found the 2 rounds of ammunition which violated the SAFE Act.

It is unclear from the source article exactly why the DA chose not to prosecute, but we hope that some common sense in regards to NY’s gun laws is prevailing.
